These Operating Rules are provided to make using our service a positive and secure experience for all members.
By completing the sign-up process and using FatPipes Hosting (other than to read the Terms of Agreement and Operating Rules for the first time), you agree to be bound and abide by the Terms of Agreement and Operating Rules, just as if you had signed the Agreement. If you do not wish to be bound by our Terms of Agreement and Operating Rules, you may not continue to use the Service. In that case, you should immediately terminate your Membership account by calling (858)phone number or e-mailing us at admin@FatPipes Hosting.com.

INTRODUCTION
These Operating Rules are part of the terms of your Agreement with FatPipes Hosting, and you are bound by them. FatPipes Hosting may modify these rules at any time by publishing the modified rule(s) over our service.

COPYRIGHT
The copying, redistribution, or publication of any part of FatPipes Hosting is prohibited, except as expressly provided below.

COPYRIGHTED MATERIAL
Copyrighted material must not be placed on our service without the permission of the owner(s) or person(s) they specifically authorize.

Members may download copyrighted material for their own use. Except as expressly provided by copyright law, copying, redistribution, or publication must be with the express permission of FatPipes Hosting and the owner(s) or such authorized person(s), if other than FatPipes Hosting. Any copying, redistribution or publication of copyrighted material, any changes to or deletion of author attribution or copyright notice are prohibited.

PUBLIC DOMAIN MATERIAL
Any member may upload public domain programs to FatPipes Hosting. Any member may download public domain programs for their own use or non-commercially redistribute a public domain program. Member assumes all risks regarding the determination of whether a program is in the public domain.

CONTENTS AND USES OF THE SERVICE
Member agrees not to publish on or over FatPipes Hosting any information, software or other content which violates or infringes upon the rights of any others or which would be deemed illegal under Canadian or US laws, or which, without the approval of FatPipes Hosting, contains any advertising or any solicitation of others to use goods or services.. This paragraph, however, shall not be interpreted to restrict members from utilizing e-mail (electronic mail) in the conduct of a legitimate business except that the member may not send unsolicited advertising or promotional material.

Member acknowledges that he/she/it is expressly prohibited from utilizing FatPipes Hosting, FatPipes Hostings' equipment or any FatPipes Hosting electronic mail address in connection with the sending of the same or substantially similar unsolicited electronic mail message, whether commercial or not, to a large number of recipients. This prohibition extends to the sending of unsolicited mass mailings from another service which in any way implicates the use of FatPipes Hosting, FatPipes Hostings' equipment or any FatPipes Hosting electronic mail address.

Member specifically agrees that he/she/it will not utilize FatPipes Hosting, FatPipes Hostings' equipment or any FatPipes Hosting electronic mail address in connection with the transmission of the same or substantially similar unsolicited message to 50 or more recipients in a single day. For each day upon which this provision is violated, Member agrees to pay FatPipes Hosting damages to compensate for the lost goodwill such a violation causes. Member agrees to pay FatPipes Hosting $100 per day for an unintentional violation of this provision, but where warranted, such as in the case of an accidental transmission, FatPipes Hosting may waive all or part of the applicable charge. In cases of willful violations of this provision, Member agrees to pay FatPipes Hosting $2000 per day. FatPipes Hosting at its sole discretion shall determine whether a violation was unintentional or willful. Payment by member under this provision shall not prevent FatPipes Hosting from seeking to obtain other legal remedies against member, including other damages or an injunction.

Member agrees that any personal web page or site Member publishes in connection with FatPipes Hosting is intended for personal use. While other uses (e.g. commercial) are not prohibited, they may draw sufficient third party visits ("hits") to the page or site so as to impose a burden on the Service by reducing available bandwidth. To ensure that all Members can use and enjoy the Service, Member agrees that FatPipes Hosting is entitled to suspend or terminate access to any Member's web page or site if FatPipes Hosting determines that the page or site has, on any single day, received download traffic of fifty megabytes (50,000K) or more. Member expressly agrees that FatPipes Hosting shall not be liable to Member or parties interacting with Member for any damages resulting from action FatPipes Hosting takes to enforce this provision.

Member agrees not to harass (sexually, racial or otherwise) other members of our service or any other service accessed through FatPipes Hosting.

Member agrees not to use language in public which violates or infringes upon the rights of any others or which would be abusive, profane or sexually offensive to an average person.

Member agrees not to use the facilities and capabilities of this service to conduct any business or activity or solicit the performance of any activity which is prohibited by law or to solicit members to become members of other competitive online services.

Current rates for using FatPipes Hosting may be obtained by FatPipes Hosting' Home Page at "http://www.FatPipes Hosting.com/". FatPipes Hosting reserves the right to increase fees, surcharges, monthly membership fees or to institute new fees at any time upon thirty (30) days prior notice. FatPipes Hosting may reduce these fees at any time without notice to Member. In the event that a Member's account is terminated or canceled, on-line time credited to Member's account is not convertible to cash or other form of credit. If FatPipes Hosting does not receive the full amount of Member's account balance within thirty days (30) days of the invoice date or billing date, the lesser of an additional 2%, or the highest percentage allowed by law, of the outstanding balance will be added to Member's bill as a late charge each month and shall be due and payable. Member shall also be liable for all attorney and collection fees arising from FatPipes Hosting' efforts to collect any unpaid balance of Member's account(s).

Unlimited Access means unlimited access by you, the person. It does not mean access by your agents, robots, servers, scripts or keep alive products. Our prices and services are competitive and generous, and it should be obvious to the most casual observer that if our unlimited access policy is abused, we would be obligated to terminate the service of the abuser, as quality access for all of our clients cannot be sustained if the policy is abused.

EDITING AND DELETING CONTENT
FatPipes Hosting reserves the right in its sole discretion to edit or delete any information, software or other content appearing on our service, regardless of whether it violates the standards for content.

CANCELLATION POLICY

If you need to cancel your account with us, we require written E-mail notification to ensure that your account gets cancelled in an efficient and timely manner. Cancellation requests must be sent to sales@FatPipes Hosting.com. You will receive a confirmation once your cancellation has been processed.

Please be sure to send us your cancellation notice prior to your next billing date, if your request is received after you have already been billed, you will be responsible for paying for the entire month and your account will be closed at the end of that month. If you are unsure of what your next billing date is, please do not hesitate to contact us at sales@FatPipes Hosting.com , we will be more than happy to provide this information to you.

SERVICE TERMINATION
FatPipes Hosting reserves the right in its sole discretion to suspend or terminate service to any member at any time. Time lost due to suspension or termination will not be reimbursed.

ACCOUNT PASSWORDS
Account passwords will not be given out under any circumstance. Members will have to contact us at sysop@FatPipes Hosting.com and passwords will only be sent to the billing/primary contact E-mail address All members are responsible for any & all activity done on their account. *Keep your password confidential*

REFUNDS
Under NO circumstances will money be refunded. Any compensations made will be in the form of on-line time.

INDEMNIFICATION
Member agrees to indemnify and hold FatPipes Hosting harmless from any claims and expenses, including reasonable attorney's fees, related to member's violation of the Terms of Agreement, including these rules or any information, software or other content placed on FatPipes Hosting by the member.

TERMS OF AGREEMENT

1. Upon notice published on FatPipes Hosting, we may modify this agreement, the Operating Rules or prices, and may discontinue or revise any or all other aspects of our service at its sole discretion and without prior notice.

2. Member agrees to indemnify FatPipes Hosting against liability for any and all use of member's account.

3. Member is responsible for and must provide all telephone and other equipment and services necessary to access FatPipes Hosting.

4. Member expressly agrees that use of the service is at member's sole risk. Neither FatPipes Hosting nor, employees, or agents warrant that the service will be uninterrupted or error free; nor does FatPipes Hosting make any warranty as to the results to be obtained from use of our service. This service is distributed on an "As Is" basis without warranties of any kind. Neither FatPipes Hosting nor anyone else involved in creating, producing or delivering the service shall be liable for any direct, indirect, incidental, special or consequential damages arising out of use of the service or inability to use the service.

5. Except as expressly permitted in the Operating Rules, member may not reproduce, redistribute, retransmit, publish or otherwise transfer, or commercially exploit, any information, software or other content which they receive through FatPipes Hosting.

6. Member must pay membership fee in full before use of service may begin.

7. Fraudulent use of Credit Cards, Checks or PayPal will result in suspension of accounts and possible prosecution.

8. Member agrees that all information provided on the registration form is accurate. Accounts found to contain false information will be terminated immediately. If you have incorrectly filled out your registration please write to admin@FatPipes Hosting.com with the correct information so we can update your file. All personal information is held in confidence.
